COMPLAINTS ON VIOLATION OF PROVISIONS TO PROTECT SUNGAI PULAI MANGROVES AND IMPINGEMENT ON HUMAN RIGHTS

 

I would like to draw your kind attention to the following matter:

 

2. The proposed development of 913 ha of petrochemical and maritime industries at Tanjung Piai, which was approved by the Malaysian Government, has violated the existing provisions to protect Sungai Pulai mangroves.

 

3. The proposed area for development was a forest reserve listed as “Environmental Sensitive Area (ESA) Rank 1” by the Comprehensive Development Plan 2006-2025 and the National Physical Plan (2005). It used to be part of Sungai Pulai Forest Reserve but then excised by the Johor State in 2005 before degazettment has taken place.

4. Under the National Physical Plan (2005), “no development, agriculture or logging shall be permitted except for low-impact nature tourism, research and education in Environmentally Sensitive Area (ESA Rank 1)”. It is clear that the Malaysian Government has ignored the provisions to protect resources. The clearing of vast tract of mangrove reserve demonstrates Malaysian Government's  lack of committment in adhering to the agreement of the Convention of Biological Diversity (CBD) and Ramsar Convention, in which Malaysia is a signatory party.

 

5. The proposed project also impinge on the rights of close to a thousand subsistence fishermen around Sungai Pulai to continue fishing. Their protests have been numerously highlighted in the media.
